1. About New Habitz
New Habitz® ("New Habitz", "we", "us", "our") is a digital wellbeing service that delivers personalised mindful moments, reflection prompts, and guided grounding experiences through WhatsApp and related digital channels.
New Habitz is not a medical service, healthcare provider, therapy practice, or mental health treatment provider. Our services are intended solely for general wellbeing, mindfulness, reflection, and lifestyle support purposes.
By accessing or using our services, you agree to these Terms of Service.
2. The Service
New Habitz may provide:
• Personalised mindful moments delivered through WhatsApp
• Guided breath awareness, grounding, and reflection practices
• Early access communications and updates via email
• Digital wellbeing content and related experiences
Our services are delivered through the WhatsApp Business Platform and related third-party infrastructure providers.
To use certain parts of our service, you may need an active WhatsApp account and internet connection.
3. Not Medical Advice
New Habitz is a digital wellbeing service designed to support presence, reflection, daily rhythm, and general wellbeing. Our content is intended for informational and lifestyle support purposes only and is not a substitute for professional medical or mental health care.
We do not provide medical advice, psychological advice, psychotherapy, counselling, diagnosis, or treatment.
We do not diagnose, treat, cure, or prevent any medical or psychological condition.
If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, contact a qualified healthcare professional or emergency service immediately.

4. Eligibility
You must be at least 16 years old to use our services.
By using our services, you confirm that you meet this requirement and that you are legally capable of entering into binding agreements.
5. Subscriptions and Payments
Certain services may be offered through recurring subscription plans.
Current subscription offerings may include:
• Return to Now — EUR 11.99 per month
• Nourish Your Now — EUR 21.99 per month
Subscription pricing, features, and availability may change over time.
Payments are processed securely through third-party payment providers, including Shopify Payments and related payment infrastructure providers.
By subscribing, you authorise recurring charges to your selected payment method unless cancelled before the next billing cycle.
Founding member pricing, where offered, remains valid only while the subscription remains active and in good standing.
6. Cancellation and Refunds
You may cancel your subscription at any time.
Cancellation will take effect at the end of the current billing period. Unless otherwise required by applicable law, subscription fees already paid are non-refundable.
If you experience a technical issue preventing reasonable access to the service, contact us within 7 days at hello@newhabitz.com and we will review your request.
7. Shared Access (Nourish Your Now)
Certain subscription plans may include the ability to share access with one additional user.
Shared access is intended solely for personal, non-commercial use and remains subject to these Terms of Service.
We reserve the right to limit, suspend, or revoke shared access in cases of misuse or abuse.
8. WhatsApp Communications
By subscribing to our WhatsApp service, you explicitly consent to receive messages, updates, and wellbeing-related communications from New Habitz through the WhatsApp Business Platform.
You may opt out at any time by replying STOP to any message or by contacting hello@newhabitz.com.
We do not send unsolicited communications.
9. Acceptable Use
You agree not to:
• Use the services for unlawful or harmful purposes
• Reproduce, distribute, copy, or commercially exploit our content without permission
• Attempt to interfere with, disrupt, or compromise the security or functionality of the services
• Misrepresent your identity or misuse shared access features
• Reverse engineer, duplicate, or attempt to extract source material or proprietary systems
10. Intellectual Property
All content, branding, designs, methodologies, copy, visuals, trademarks, and related intellectual property associated with New Habitz remain the exclusive property of New Habitz or its licensors.
No part of the services may be copied, reproduced, distributed, modified, or used commercially without prior written permission.
11. Availability of Services
We aim to provide reliable and uninterrupted services but do not guarantee that the services will always be available, uninterrupted, error-free, or compatible with every device or platform.
Temporary interruptions may occur due to maintenance, updates, third-party provider issues, or technical circumstances beyond our control.
12. Limitation of Liability
To the maximum extent permitted by applicable law, New Habitz shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the services.
Our total aggregate liability for any claim relating to the services shall not exceed the amount paid by you to New Habitz during the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability where exclusion is prohibited under applicable law.
13. Changes to the Services or Terms
We may update, modify, suspend, or discontinue parts of the services at any time.
We may also update these Terms of Service periodically. Updated versions will be published on our website with the revised effective date.
Where required by law or where changes materially affect users, we will provide reasonable notice.
14. Governing Law
These Terms of Service are governed by and interpreted in accordance with the laws of the Netherlands.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
